Performance regime review
ORR’s review of the Schedule 8 performance regime is intended to consider whether:
- the current objectives of the regime are appropriate;
- the current regime fulfils those objectives;
- the current regime imposes unwarranted bureaucracy and cost in relation to the benefits of the regime; and
- changes should be implemented through this review, for example to improve the alignment of incentives with responsibilities in line with the proposals in the Government’s White Paper The Future of Rail.
Background
The Schedule 8 performance regime is within franchised passenger train operators’ track access contracts. It provides an incentive to both Network Rail and train operators to seek to minimise lateness and cancellation of train services. It also enables train operators to be appropriately compensated for the effects on their revenue resulting from poor performance by Network Rail.
The Schedule 8 performance regime was last fully reviewed as part of the 2000 access charges review. The Government’s Rail Review White Paper proposes Network Rail will have responsibility for the delivery of whole-industry performance. It is considered, therefore, appropriate to review whether changes can be made to the regime to enhance its effectiveness and support the changes to the structure and roles in the industry proposed by the White Paper.
Timescales
The review started formally with the publication of the Review of the Schedule 8 performance regime document on 2 November 2004. On 11 March 2005, the Emerging views and further issues document was published.
