Condition 7 of Network Rail’s network licence requires it to publish an annual business plan by 31 March each year (or another date the Office of Rail Regulation has specified).
The network operator is required to demonstrate in its annual business plan how it plans to operate, maintain, renew, replace, enhance and develop the network. It must do this in accordance with best practice, in a timely, economic and efficient manner so as to satisfy the reasonable requirements of its customers and funders.
The annual business plan must be prepared in a format and structure specified by the ORR (in a formal notice to the licence holder by 15 December each year) and must also include detailed information set out in paragraph 5 of Condition 7 of the network licence.
The network operator must publish as part of its annual return to the ORR an annual reconciliation statement detailing work carried out during the previous year, reasons for any divergence from the plans set out in the relevant annual business plan, and where appropriate, the steps proposed to remedy any shortcomings.
