ORR sets out emerging views on the review of Schedule 8 of franchised passenger operators’ track access contracts (the performance regime)

The Office of Rail Regulation (ORR) has today published its emerging views and further issues document as part of its review of the Schedule 8 of franchised passenger operators’ track access contracts (the performance regime).
The regime is widely recognised as an important method of compensating train operators for the impact on their revenue from poor performance. It also reinforces other incentives and obligations on Network Rail and train operators to improve performance for the benefit of passengers and freight users.
ORR’s emerging view is that the structure of the Schedule 8 regime . should largely be retained but that a number of modifications should be made to ensure that payment rates under the regime accurately reflect the revenue effects of lateness and cancellation of trains; compensation payments in different parts of the contractual structure are streamlined; and Network Rail’s performance improvement targets are aligned with train operators’ franchise obligations.
The document also consults the industry on a further issue of whether the regime should exclude train operator payments to Network Rail.
