| 12 April 2002 ORR/04/02 The Rail Regulator, Tom Winsor, is consulting on how Railtrack proposes to fulfil the requirement in Condition 25 of its network licence to produce an enforceable code of practice in its non-contractual and extra-contractual dealings with dependent persons. Railtrack accepted the modification to its network licence on 3 May 2001. Commenting on the need for consultation Tom Winsor said: "Railtrack has a wide range of customers dependent upon it. It is important that Railtrack is and is seen to be reasonable, responsive, prompt and competent in its dealings with its customers. I introduced the concept of a code of practice in the licence to assure customers that Railtrack will act efficiently, economically and in a timely manner, and will exercise the skill, diligence, prudence and foresight expected of a skilled and experienced network facility owner and operator. "I am consulting on the proposals that Railtrack made just prior to being placed in administration as I believe that whatever form is chosen for its successor, dependent customers should be given the surety of a code of practice. By undertaking a consultation at this stage, dependent customers will be able to influence the final shape of the code." This new licence condition will introduce a single, enforceable code of practice with specific parts addressing the needs of specific customers, providing a common approach in key areas with ease of comprehension for users. The publication of the code on Railtrack's website will enable potential customers to know what to expect in their dealings with Railtrack, and a timetable for the introduction of the code allows for existing codes to be incorporated into the new code of practice as appropriate.
