Better contracts for a growing railway

The Rail Regulator, Tom Winsor, has today published the secondconsultation document on standard clauses for track access agreements. Thissecond document sets out the key issues that have emerged in consultation withthe railway industry since the Regulator launched the consultation process on 7January 2000.

Commenting on todays document, Tom Winsor said:

"I have been greatly encouraged by the enthusiasm whichhas been shown by all concerned for the work to establish standard clauses.Standard clauses help to set in place better track access agreements that willassist franchise replacement and ensure that railway companies, includingRailtrack, are properly empowered in their business relationships. Theconsultation process has tapped the expertise of everyone in the industry in aconstructive and open manner. This means that the debate will take place oncewith maximum information available, instead of in a series of partially informedbilateral negotiations. It is my present view that simpler and clearerarrangements will be in everyones interest."

Notes for editors:

Section 21 of the Railways Act 1993 empowers the Regulator torequire or encourage the use of standard clauses in new track access agreementsbetween Railtrack and train operators. The Regulator does not have powers torequire amendments to extant access agreements, and the present consultationexcludes those aspects of a track access agreement which are being dealt withunder the periodic review of Railtracks access charges.
