Consultation on changes to the operator licences

We needed to make changes to a few licence conditions because we expect shortly to become the enforcement body for the EU Passenger Rights and Obligations Directive (the PRO). These changes affect anyone holding station licences granted under the Railways Act 1993 (“the Act”), or passenger train statements of national regulatory provisions (SNRPs) which are granted by ORR alongside European passenger licences, or anyone intending to apply for them.

We were given powers under domestic law to make these changes without the consent of the licence holder, but we invited views on the approach we proposed to take and any comments on the drafting. The changes have now been made and the SNRPs and licences have now been modified.

We also wanted to change other conditions to reflect changes we made to Network Rail’s network licence last year and to otherwise update them. These changes are relevant to anyone holding either a station or passenger licence under the Act or a passenger SNRP. These changes will be made under the normal change procedures in the Act and so will need the consent of the licence holder. We are consulted informally to gather views on the proposals. We are considering reactions and we will consult again more formally in due course.

Responses to both issues were sought by 16 July 2010. The consultation has now closed. The responses are set out below.
